Work permit in Turkey:
Foreigners must obtain a work visa to work in Turkey. In addition, they must obtain a work permit. Law No. 4817, Concerning the Permit of Exiled Persons, on March 3, 2003 introduced major changes to Turkish law. One of the most fundamental changes is to have the appropriate reference for work permits, the Ministry of Labor and Social Security. The new law introduced four types of work permits that year. The following describes each type of license:
1. Long-term / restricted license: This license is granted for a maximum of one year and takes into account factors such as labor market conditions and so on. However, people should be aware that this period may be up to 3 years depending on the circumstances;
2. Unlimited License: Unlimited license is usually granted to a person who has been legally and indefinitely resident in Turkey for 8 years or has worked there for a full 6 years. Another important factor to note is that under this type of license, a work permit is granted without any conditions. However, foreigners need to be licensed by the police. The next step is to provide all the necessary documentation for the ministry. Applicants should keep in mind that the eight-year period does not cover study time;
3. Independent authorization: Independent authorization is granted to those foreigners who have been legally and indefinitely resident in Turkey for at least five years. In addition, any foreigner who qualifies for an independent work permit is initially granted a permit to apply for an independent work permit. This license is valid for 3 months from the date of issue;
4. License for specific persons: There are exceptions when a work permit is issued independently of the conditions listed by law. These exceptions include:
4.1 Foreigners who are married to Turkish citizens and legally reside in Turkey with their spouses. However, if their marriage results in separation before the end of three years, then the work permit will be invalid;
4.2 Foreign nationals established pursuant to the survey;
4.3 Foreigners who have lost Turkish citizenship – this will apply only to those listed under Article 19.27 and Article 403 of Turkish Citizenship;
4.4 Foreigners who have completed their education in Turkey (and must have reached puberty). However, there is one exception to the law, which states that foreigners who were born in Turkey or are under the age of 18 must be licensed to work to obtain a university degree, etc. in Turkey. 4,5 foreigners who fall within the scope of Law No. 2510;
